These Terms of Service (Terms) govern your purchase and use of content from The Swim Buddy Playbook, LLC (Swim Buddy Playbook, we, us, or our). By purchasing our course or subscribing to our membership, you agree to these Terms and our Privacy Policy.

1. Our Services

Educational Content. Swim Buddy Playbook provides educational content for couples designed to enhance communication and relationship skills from the perspective of Otters. Our content is created by Dr. Bruce Rumsey, a professional counselor, and includes:

NOT THERAPY OR COUNSELING. THE SWIM BUDDY PLAYBOOK IS EDUCATIONAL CONTENT ONLY. IT IS NOT THERAPY, COUNSELING, MENTAL HEALTH TREATMENT, OR PROFESSIONAL MEDICAL ADVICE. While Dr. Bruce Rumsey is a professional counselor, he is NOT providing professional counseling services through this course or membership. The content is educational in nature and designed to supplement, not replace, professional relationship counseling or therapy.

NOT A SUBSTITUTE FOR PROFESSIONAL HELP. THIS COURSE DOES NOT SUBSTITUTE FOR PROFESSIONAL COUNSELING, THERAPY, OR MENTAL HEALTH TREATMENT. If you are experiencing relationship problems, mental health issues, domestic violence, abuse, or any serious relationship crisis, you should seek help from a licensed mental health professional, marriage counselor, or appropriate professional service immediately.

NO GUARANTEES OR PROMISES. WE MAKE NO GUARANTEES, PROMISES, OR WARRANTIES ABOUT THE OUTCOME OF YOUR RELATIONSHIP. We do not promise that this course will solve your relationship problems, improve your relationship, prevent relationship difficulties, or lead to any specific outcome. Relationship success depends on many factors beyond our control, and results vary widely.

GUIDANCE AND ENHANCEMENT ONLY. This course is intended to be a guide to enhance and supplement your current relationship goals. It is designed to provide educational information and perspectives that may help you think about communication in your relationship. It is not a comprehensive solution to relationship problems.

NO LIABILITY FOR RELATIONSHIP OUTCOMES. SWIM BUDDY PLAYBOOK AND DR. BRUCE RUMSEY ARE NOT RESPONSIBLE FOR THE OUTCOME OF YOUR RELATIONSHIP. We are not liable for any relationship difficulties, breakups, divorces, conflicts, or other relationship issues that may occur during or after your use of this course. Your relationship outcomes are your own responsibility.

SEEK PROFESSIONAL HELP IF NEEDED. If at any time you experience serious relationship problems, thoughts of harm to yourself or others, domestic violence, abuse, or mental health crises, STOP using this course and seek immediate professional help from a licensed counselor, therapist, crisis hotline, or emergency services.

3. Eligibility and Account

Age Requirement. You must be at least 18 years old to purchase our course or subscribe to our membership.

Accurate Information. You agree to provide accurate contact information, including a valid email address and phone number, so we can deliver content to you.

Account Security. You are responsible for maintaining the confidentiality of your account login credentials and for all activities under your account.

4. Course and Membership Structure

One-Time Course. You may purchase a one-time access to our core relationship communication course. Once purchased, you will have ongoing access to the course content for as long as the course is available.

Monthly Membership (Optional). You may optionally subscribe to our monthly membership, which provides ongoing weekly content deliveries designed to help you and your partner with listening and talking. The membership includes regular video content delivered via email and SMS.

Separate Purchases. You can purchase the one-time course without subscribing to the monthly membership, or you can subscribe to the monthly membership separately.

Custom Crafted Content. All content is custom crafted for our community and delivered as educational material.

5. SMS Text Message Delivery

Consent to Receive SMS. By providing your phone number and purchasing our course or subscribing to our membership, you consent to receive SMS text messages containing course content, membership updates, and service notifications. Message and data rates may apply.

SMS Delivery. SMS messages are delivered through Delightful OS. You acknowledge that SMS delivery depends on your mobile carrier and is subject to network availability.

Opt-Out. You may opt out of SMS messages at any time by replying STOP to any message or contacting us at ops@swimbuddyplaybook.com. However, opting out may affect your ability to receive course content.

6. Payment Terms

Course Purchase. The one-time course is a single payment for lifetime access to the course content.

Monthly Membership. The monthly membership is a recurring subscription billed monthly. You authorize us to charge your payment method automatically each month until you cancel.

Payment Processing. All payments are processed through Stripe, a third-party payment processor. By making a purchase, you agree to Stripe's terms of service and privacy policy.

Failed Payments. If your payment method fails, we will attempt to process payment for up to 7 business days. If payment cannot be processed, your membership access will be suspended.

Price Changes. We reserve the right to change our prices at any time. Price changes will not affect existing course purchases but may apply to membership renewals with 30 days notice.

7. NO REFUNDS - Custom Content

NO REFUND POLICY. ALL SALES ARE FINAL. Because our content is custom crafted and immediately accessible upon purchase, we do not offer refunds for course purchases or monthly membership fees. This applies to both the one-time course and monthly membership subscriptions.

Membership Cancellation. You may cancel your monthly membership at any time, but you will not receive a refund for the current billing period. Cancellation will take effect at the end of your current billing cycle.

Exceptions. Refunds may be issued only as required by law or in Swim Buddy Playbook's sole discretion for extraordinary circumstances.

8. Intellectual Property and Usage Rights

Content Ownership. All course content, videos, materials, and intellectual property are owned by Swim Buddy Playbook and Dr. Bruce Rumsey and are protected by copyright law.

Personal Use License. You are granted a personal, non-exclusive, non-transferable license to access and use the course content for your own personal relationship education. You may not:

You agree to use our services only for lawful purposes and in accordance with these Terms. You agree not to:

Our Right to Terminate. We may suspend or terminate your access to our services at any time, with or without cause, with or without notice. Termination will not entitle you to a refund.

Your Right to Cancel. You may cancel your monthly membership at any time by contacting us at ops@swimbuddyplaybook.com. Cancellation takes effect at the end of your current billing period.

11. Disclaimers and Limitation of Liability

AS-IS SERVICE. OUR SERVICES ARE PROVIDED AS IS AND AS AVAILABLE WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE CONTENT WILL MEET YOUR NEEDS, BE ERROR-FREE, OR PRODUCE SPECIFIC RESULTS.

NO LIABILITY FOR OUTCOMES. SWIM BUDDY PLAYBOOK, DR. BRUCE RUMSEY, AND OUR OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY DAMAGES, LOSSES, OR INJURIES ARISING FROM YOUR USE OF OUR SERVICES OR THE OUTCOME OF YOUR RELATIONSHIP, INCLUDING BUT NOT LIMITED TO RELATIONSHIP PROBLEMS, BREAKUPS, DIVORCES, EMOTIONAL DISTRESS, LOST TIME, OR ANY OTHER CONSEQUENTIAL DAMAGES.

LIMITATION OF LIABILITY. TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE THREE MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify, defend, and hold harmless Swim Buddy Playbook, Dr. Bruce Rumsey, and our officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from:

13. Dispute Resolution

Governing Law. These Terms are governed by the laws of the State of Colorado, without regard to conflict of law principles.

Arbitration. Any dispute arising from these Terms or our services shall be resolved through binding arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules. The arbitration shall take place in Littleton, Colorado.

CLASS ACTION WAIVER. YOU AGREE THAT ANY DISPUTE SHALL BE BROUGHT INDIVIDUALLY AND NOT AS A CLASS ACTION. YOU WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT.

TIME LIMIT. ANY CLAIM MUST BE BROUGHT WITHIN THREE (3) MONTHS AFTER THE EVENT GIVING RISE TO THE CLAIM.

14. General Provisions

Entire Agreement. These Terms and our Privacy Policy constitute the entire agreement between you and Swim Buddy Playbook.

Modification. We may modify these Terms at any time. Continued use after changes constitutes acceptance.

Severability. If any provision is found invalid, the remaining provisions remain in effect.

No Professional Relationship. Purchasing this course does not create a counselor-client, therapist-patient, or other professional relationship with Dr. Bruce Rumsey or Swim Buddy Playbook.
